Temporary Skill Shortage Visa (Subclass 482)
The newly introduced Australian employer-sponsored immigration 482 visa in 2018, also known as TSS (Temporary Skilled Shortage visa), is an immigration program launched by the DHA to replace original 457 visa, aiming to introduce overseas talents to alleviate temporary skills shortages in the Australian labour market while ensuring Australian workers are given priority.
A 482 visa applicant must be sponsored by a qualified Australian employer in order to work in Australia, and the applicant who is eligible can apply for 186 or 187 visa to be permanently resident.
Temporary Skill Shortage Visa (Subclass 482) Streams
Short-term stream
This stream is for short-term skilled workers with a genuine sponsorship from an Australian employer. Applicants of this stream must have an occupation on the Short-term Skilled Occupation List (STSOL). Visa holders can work for the employer for no more than two years, or for up to four years if an International Trade Obligation (ITO) applies.
Medium-term stream
This stream is for medium and long-term skilled workers with a genuine sponsorship from an Australian employer, and applicants must have an occupation on the Medium and Long-term Strategic Skills List (MLTSSL) or on the Regional Occupation List (ROL). Visa holders can work for the employer for no more than four years, or apply for visa renewal;
Labour agreement stream
This stream is for applicants who are employer-sponsored through a labor agreement.
Eligibility
TSS visa is divided into three streams: the short-term stream that cannot be transferred to PR, the medium-term stream that can be transferred to PR, and the labor agreement stream, which have different additional requirements for applicants.
General requirements (applicable to all streams)
- Be nominated by an approved sponsor
- Meet the skills and qualification requirements of the nominated occupation and have a positive skills assessment(if any)
- Meet the English language requirements
- Applicants in Australia need to hold a substantive visa or bridging visa (Bridging A/B/C visa)
- Meet the health and character requirements
- Meet the additional requirements for the visa stream applied for
Additional requirements for short-term stream:
- Have worked in your nominated occupation or a related field for at least 2 years within the last 5 years
- Be a genuine applicant for entry and stay as a short term visa holder
- The nominated occupation must be on the Short-Term Skilled Occupation List (STSOL)
- Must meet minimum standards of English language proficiencyunless exemptions apply
- The visa can only be renewed once, and the holder can apply for permanent residence if eligible
Additional requirements for medium-term stream:
- Have worked in your nominated occupation or a related field for at least 2 years within the last 5 years
- The nominated occupation must be on the Medium and Long-term Strategic Skills List (MLTSSL) or on the Regional Occupation List (ROL);
- Must meet minimum standards of English language proficiencyunless exemptions apply
- Unlimited visa renewal is possible. After 3 years of work, the holder can apply for 186/187 permanent residence visa.
Advantages of TSS 482 visa
- You can work in Australia for up to four years;
- You can bring your family members (spouse and dependent children) to Australia to work or study together;
- You can freely travel to and from Australia while the visa is valid;
- English language requirements are low;
- Holders of medium-term stream can apply for permanent residence in Australia after working for three years.
